Liability for defects
Effective from April 1, 2026
In accordance with Act No. 40/1964 Coll. (Civil Code) and Act No. 108/2024 Coll. on consumer protection.
1. Liability for defects
The seller provides a statutory warranty period of 24 months from the date of receipt of goods by the buyer. The warranty begins on the day the buyer receives the goods. A warranty card is not mandatory — the invoice or order confirmation serves as proof of warranty.
2. When we are not liable
The seller is not liable for defects caused by: mechanical damage (drops, impacts, cracks); misuse contrary to the user manual; unauthorized modification, repair or alteration by the buyer or a third party; water damage beyond the declared resistance (IP67); natural wear during normal use (battery, surface finishes, straps); use of incompatible accessories or third-party chargers; damage caused by force majeure (fire, flood, lightning, etc.); defects known to the buyer at the time of purchase. The warranty does not apply to consumables (straps, charging cables) after their normal service life.
3. How to notify a defect
Notify the defect by email to admin@nowfitness.eu or by post. Include proof of purchase (invoice or order number), a description of the defect — what fails and when it appeared, photos of the defect, and your contact details. Send the goods at your own cost; if we are liable for the defect, we will reimburse the necessary delivery costs. Do not send cash on delivery — such parcels will not be accepted.
4. Remedying the defect
We will confirm receipt of your defect notification by email. We will remedy the defect no later than 30 days from the day it was notified. You may choose between repair and replacement — we may refuse your choice only if it is impossible or would cause us disproportionate cost compared with the other option. You are entitled to a proportionate price reduction or to withdraw from the contract if we failed to remedy the defect within a reasonable time or refused to remedy it, if the defect recurs, or if it amounts to a material breach of contract.
5. If we decline liability
If we decline liability for the defect, we will tell you in writing together with the reasons. In that case you bear the cost of assessment and of returning the goods.
